General Conditions

Transire Intermodal Logistics B.V. provides logistics, forwarding, transport and related services. Depending on the nature of the services performed, the following terms, conditions and conventions apply.

Road transport

For domestic road transport within the Netherlands, the General Transport Conditions 2002 (Algemene Vervoerscondities 2002 – AVC) apply.

For international carriage of goods by road, the Convention on the Contract for the International Carriage of Goods by Road (CMR) applies. Where applicable and insofar as not inconsistent with mandatory provisions of the CMR, the AVC may apply additionally.

Freight forwarding and other services

Unless otherwise expressly agreed in writing, all other forwarding and logistics services performed by Transire Intermodal Logistics B.V. are subject to the Dutch Forwarding Conditions (Nederlandse Expeditievoorwaarden), as deposited by FENEX, with the exception of the arbitration provision referred to in Article 23.

Warehousing

Where warehousing or storage services are provided and the applicable agreement or nature of the services so requires, the relevant Dutch Warehousing Conditions may apply.

Applicable version

Unless otherwise agreed in writing, the latest applicable and duly deposited version of the relevant terms and conditions in force at the time the agreement is concluded shall apply.
